  • Ticket Frequency You will receive an email every 3 months (for 2 years) for each energy account (electricity/gas), on the Simply Gold Class offer. Each email will contain a unique activation code which you will need to use within a 6 month period. Once activated, you will have up to 12 months to use your Gold Class movie ticket. The ticket cycle (1 ticket every 3 months, for 2 years) starts after your account (electricity/gas) has been successfully transferred to Simply Energy, on the Simply Gold Class offer. You should therefore receive your first ticket before your first bill for each account. If you’re an existing Simply Energy customer, you should receive your first ticket within 3 months of switching to the Simply Gold Class offer.

  • IMPORTANT INFORMATION: Tickets are issued per account, and your electricity and gas accounts may transfer to this offer at different times (due to meter reads on different days/months). Therefore it is common to receive your ticket for each account at different times. If you have a Solar PV energy system, you will need to contact us on 13 88 08 to sign up to this offer. These vouchers are not valid for, group bookings, movie marathons, and special events or in conjunction with any other offer or promotion unless otherwise stated. A surcharge applies to 3D/Real D films.
  • Online Welcome Credit1.Up to $50 Online Welcome Credit - A $25 credit will be applied to the first Simply Energy electricity bill you receive after you accept this energy plan. A $25 credit will be applied to the first Simply Energy gas bill you receive after you accept this energy plan (if applicable). The credit(s) will only apply if you sign up to the energy plan online via the Simply Energy website. The credit(s) will be applied prior to GST and are not redeemable for cash.
  • Eligibility2.You will be eligible to receive Village Cinemas Gold Class movie ticket vouchers in relation to your Simply Energy electricity market contract when responsibility for the electricity supply for your premises transfers to Simply Energy.
  • 3.If applicable, you will be eligible to receive Village Cinemas Gold Class tickets in relation to your Simply Energy gas market contract when responsibility for the gas supply for your premises transfers to Simply Energy.
  • 4.You will not be eligible to receive or activate any movie ticket vouchers in relation to your Simply Energy electricity market contract if your electricity market contract is cancelled, rescinded or terminated before the electricity supply for your premises is transferred to Simply Energy and you will not be eligible to continue to receive or activate any movie ticket vouchers if your electricity market contract with Simply Energy is cancelled, rescinded or terminated at any time before the end of the fixed term.
  • 5.You will not be eligible to receive or activate any movie ticket vouchers in relation to your Simply Energy gas market contract if your gas market contract is cancelled, rescinded or terminated before the gas supply for your premises is transferred to Simply Energy and you will not be eligible to continue to receive or activate any movie ticket vouchers if your gas market contract with Simply Energy is cancelled, rescinded or terminated at any time before the end of the fixed term.
  • 6.Simply Energy reserves the right to change the provider of activation codes or movie ticket vouchers if our commercial arrangements with any supplier associated with the Simply Gold Class Offer ends. If, despite our best endeavours, we are unable to find alternative suppliers, we may end your Simply Gold Class Offer. In those circumstances we will continue to supply you with energy under your market contracts with us.
  • Pay On Time Discount7.The discount specified in the contract confirmation for paying on time (the “pay on time discount”) will be applied:
    1. in respect of those energy charges incurred for energy consumed during the billing period; and
    2. only to the usage component of your electricity rates; and
    3. only to the usage component of your gas rates (if applicable).
  • 8.You will be eligible for the pay on time discount in respect of a bill if payment of the full amount of charges specified on that bill is received by us on or before the pay-by date specified on the bill (note that payments made after business hours may not be received by us until the next business day and therefore may be ineligible for the pay on time discount). If the pay-by date is a weekend or a public holiday, payment must be received by us on or before the next business day.
  • Direct Debit9.If you agreed to set up a direct payment arrangement with us and agreed to our Direct Debit Payment Agreement at the time that you entered into the market contract with us:
    1. you will be eligible for the pay on time discount in respect of a bill if payment of that bill is actually made by direct debit or automatic payment from your credit card in accordance with our Direct Debit Payment Agreement. The amount that we debit from your nominated financial institution to pay your bill will be reduced by the amount of the direct debit discount;
    2. if you are making payment by automatic payment from your credit card you must make payment by Visa or MasterCard to be eligible for the pay on time discount; and
    3. you will not be entitled to the pay on time discount in respect of a bill (and we will not otherwise be responsible) if the direct debit or automatic payment from your credit card fails or is delayed because:
      1. you did not provide the Request for Automatic Payment form, and agree to our Automatic Payment Arrangement Conditions, within the 14 days before the next scheduled meter read date specified on your latest electricity bill;
      2. any of the details you have provided us are incorrect or incomplete; or
      3. there were insufficient clear funds or credit available in the nominated account to meet the Direct Debit Payment Agreement payment on the pay-by date.
  • Ebilling10.If you agreed to receive your electricity bills by email (ebilling) and you provided a valid email address at the time that you entered into the market contract with us:
    1. you will be eligible for the pay on time discount in respect of an electricity bill if we are actually able to send that electricity bill by email to the most recent email address you provided to us for the purposes of ebilling;
    2. you will not be entitled to the pay on time discount in respect of an electricity bill (and we will not otherwise be responsible) if:
      1. we receive an undeliverable message in relation to the electricity bill we have attempted to send to the most recent email address you provided to us for the purposes of ebilling, even if we are able to subsequently send that electricity bill to the email address or a different email address; or
      2. you request us to provide a copy of the electricity bill by post in addition to or in substitution for the electricity bill that we will send or have sent to you by email;
    3. it is your responsibility to ensure that you maintain a valid email address and whilst we may endeavour to contact you to obtain a new valid email address if we discover that your electricity bills have not been successfully delivered to the most recent email address you provided to us for the purposes of ebilling, you will not be entitled to the pay on time discount in respect of an electricity bill if we are not able to send an electricity bill by email even if we have not endeavoured to contact you to obtain a new valid email address; and
    4. you must advise us immediately of a new valid email address to which we can send your electricity bills if you cancel the email account for the most recent email address you provided to use for the purposes of ebilling.
  • General Conditions11.If you are not eligible for the pay on time discount in respect of a bill, but we apply that discount to your bill (for whatever reason), the amount of the pay on time discount will be debited to a subsequent bill.
  • 12.If you are eligible for the pay on time discount in respect of a bill, but you overpay the amount of that discount to us, that amount will be credited to your next bill. You will not be entitled to a refund of that amount before your next bill is issued.
  • 13.If your bill is based on an estimate of your energy consumption, the pay on time discount will be applied to the estimated consumption. If we subsequently receive an actual meter read, we will adjust the discount on the next bill accordingly.
  • 14.You will not be eligible for the pay on time discount if you are on a Fixed Instalment Plan at the time the relevant bill is issued.
  • 15.The pay on time discount will end at the end of your benefit period.
  • 16.No failure to exercise or delay in exercising any right, power or remedy by us operates as a waiver. A single or partial exercise of any right, power or remedy does not preclude any other or further exercise of that or any other right, power or remedy. A waiver is not valid or binding on us unless made in writing.
  • Movie Ticket Vouchers17.Simply Energy reserves the right to change the provider of activation codes or movie ticket vouchers if our commercial arrangements with any supplier associated with the Simply Gold Class Offer ends. If, despite our best endeavours, we are unable to find alternative suppliers, we may end your Simply Gold Class Offer. In those circumstances we will continue to supply you with energy under your market contracts with us.
  • 18.Subject to these terms and conditions, during the fixed term of your Simply Energy market contract you will receive activation codes for the following movie ticket vouchers: (a) in relation to your Simply Energy electricity market contract, one (1) Village Cinemas Gold Class movie ticket voucher every 3 months (maximum of 8 Village Cinemas Gold Class movie ticket vouchers); and (b) if applicable, in relation to your Simply Energy gas market contract, one (1) Village Cinemas Gold Class movie ticket voucher every 3 months (maximum of 8 Village Cinemas Gold Class movie ticket vouchers).
  • 19.Subject to seating availability, each movie ticket voucher entitles the holder to receive one (1) adult Village Cinemas Gold Class movie ticket at a participating cinemas.
  • Activation Codes20.Subject to these terms and conditions, you will be sent a unique activation code every three (3) months during the fixed term of your Simply Energy market contract. Activation codes allow you to activate your movie ticket vouchers.
  • 21.Your first unique activation code will be sent as soon as practicable after responsibility for the energy supply for your premises has been transferred to Simply Energy. Transfer of energy supply for your premises to Simply Energy may take up to 14 weeks, depending on when your last meter read occurred.
  • 22.Activation codes will be sent to you by email to the email address you provided at the time you entered into the Simply Energy market contract.
  • 23.Each unique activation code will be valid until the date specified in the email sent to you with the code. Once an activation code has expired, you will not be able to activate the movie ticket vouchers associated with that code.
  • Activating Movie Ticket Vouchers24.Movie ticket vouchers must be activated before they can be redeemed for a movie ticket.
  • 25.You can activate your movie ticket vouchers at the website www.simplygold.com.au (“Website”). You must provide the unique activation code to activate your movie vouchers.
  • Redeeming Movie Ticket Vouchers26.Subject to seating availability, a movie ticket voucher entitles the holder to receive one (1) adult Gold Class movie ticket to any session at a participating cinema.
  • 27.Vouchers are only valid until the date printed on the voucher.
  • 28. Vouchers must be surrendered at the time they are used and are subject to terms and conditions printed on the vouchers and any terms and conditions of Village Cinemas Australia Pty Ltd.
  • 29. Vouchers are non-refundable and cannot be exchanged or replaced. Change will not be given irrespective of cinema pricing.
  • 30.Booking fees may apply, if seats are booked in advance online or over the phone with Village Cinemas.
  • Privacy31. By taking up this Simply Gold Class Offer you agree to us providing Edge Loyalty Systems Pty Limited with your name, address, email address and telephone number so that your unique activation codes can be delivered to you and to facilitate this Simply Gold Class Offer. You authorise us to collect, maintain, use and disclose your personal information in the manner set out in our privacy policy available at www.simplyenergy.com.au
  • Liability32. Edge Loyalty Systems Pty Ltd is the provider of the unique activation codes and vouchers. Any queries or complaints regarding the unique activation codes or vouchers should be made to Edge Loyalty Systems Pty Ltd by calling 1300 325 422.
  • 33. Simply Energy will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for personal injury sustained, as a result of taking up the Simply Gold Class Offer, except for any liability which cannot be excluded by law.
  • 34. To the full extent permitted by law, Edge Loyalty Systems and Simply Energy make no warranties or representations, whether express or implied, regarding the Simply Gold Class Offer or the movie ticket vouchers except as expressly provided in these terms.
  • 35. To the maximum extent permitted by law, Simply Energy’s liability to you for a failure to comply with any guarantee that applies under any applicable law is excluded. Where liability cannot be excluded, Simply Energy’s liability for failure to comply with any such guarantee is limited (at Simply Energy’s option) to the replacement of the goods, the supply of equivalent goods or the payment of the cost of acquiring equivalent goods; in the case of a service, Simply Energy’s liability is limited to the re-supply of the service or the payment of the cost of having the service supplied again.
