Terms and Conditions - Movie Rewards Offer

Eligibility

1. From time to time we may offer the Movie Rewards Offer (the “Offer”) in conjunction with electricity only or electricity and gas market contracts and to be eligible for the Offer you must:

a. be eligible for and enter into a new market contract with Simply Energy for the supply of electricity or electricity and gas to your residential premises (depending on whether the Offer applies to electricity only or electricity and gas at the time you apply); and

b.responsibility for the electricity supply or electricity and gas supply (depending on whether the Offer applies to electricity only or electricity and gas at the time you apply) for your premises must be transferred to Simply Energy.

2. Movie Rewards will be provided for 12 full calendar months, beginning on the first day of the calendar month which occurs immediately after the date on which you are sent your unique code for the first time (see below under the heading Unique Codes) (“Movie Reward Period”).

3. You will not be eligible to receive any Movie Rewards if your electricity or gas market contract is cancelled, rescinded or terminated before the electricity supply or electricity and gas supply (depending on whether the Offer applies to electricity only or electricity and gas at the time you apply) for your premises is transferred to Simply Energy.

4. You will not be eligible to continue to receive or claim Movie Rewards if your electricity or gas market contract with Simply Energy is cancelled, rescinded or terminated at any time prior to the expiry of the Movie Reward Period.

5. We reserve the right to change the provider of certificates and vouchers from whom you are entitled to receive the movie tickets, movie downloads and movie rentals if our commercial arrangements with Edge Loyalty Systems Pty Limited end. If, despite our best endeavours, we are unable to find alternative providers, we may end your Offer. In those circumstances we will continue to supply you with energy under your market contracts with us.

Movie Rewards

6. Every two (2) calendar months during the Movie Reward Period you will have the choice of claiming:
a. 2 Movie Ticket certificates; OR
b. 4 BigPond Movie Download vouchers.

7. Every calendar month during the Movie Reward Period you can claim:
a. 1 Rent One Get One Free New Release DVD
Video Ezy rental voucher; AND
b. 1 Free Weekly DVD Video Ezy rental voucher.

Unique Codes

8. Unique codes allow you to claim your movie rewards. Unique codes will be sent by email, short message service (SMS) or post, depending on the method you nominate at the time you accepted the Simply Energy market contract.

9. Your first unique code will be sent as soon as practicable after responsibility for the electricity supply or electricity and gas supply (depending on whether the Offer applies to electricity only or electricity and gas at the time you apply) for your premises has been transferred to Simply Energy. Transfer of electricity and gas supply for your premises to Simply Energy may take up to 14 weeks, depending on when your last meter read occurred.

10. For security reasons, a new unique code will be sent every 2 calendar months. Each unique code will be valid until midnight on the last day of the month following the month in which that unique code was sent.

Claiming Movie Rewards

11. You can claim your movie rewards at the website www.simplymovierewards.com.au (“Website”) or by calling 1300 325 422 (“Call Centre”) (between 8.30am-5.30pm Monday-Friday AEST). You must provide a valid unique code to claim your movie rewards.

12. If you claim your Movie Rewards at the Website you can print your Movie Rewards certificates and vouchers from the Website. If you claim your Movie Rewards by calling the Call Centre, your Movie Rewards certificates and vouchers will be mailed to you as soon as practicable.

Redeeming Movie Rewards

13. Movie Rewards certificates and vouchers must be redeemed by the date printed on the certificate or voucher. Certificates and vouchers must be surrendered to redeem the Movie Rewards and are subject to terms and conditions printed on the certificates and vouchers.

Movie Ticket Certificates

14. Each movie ticket certificate is redeemable for one (1) adult movie ticket, subject to seating availability, at participating cinemas. For participating cinemas go to www.simplymovierewards.com.au.

15. Movie tickets are not valid after 5 pm on Saturday nights. The movie ticket is non-refundable and cannot be exchanged or replaced. Change will not be given irrespective of cinema pricing. The movie ticket is not valid for Gold Class, VMAX, 3D/Real D, La Premiere, Directors Suite, the halfpipe, Hoyts IMAX, 3D, xtremescreen, alternative content, special events or in conjunction with any other offer or promotion.

Movie Download Vouchers

16. To redeem movie download vouchers, you must register for a BigPond account at www.bigpondmovies.com. Each voucher entitles the holder to download one (1) movie from the BigPond website www.bigpondmovies.com. BigPond’s
standard terms and conditions apply.

Movie Rental Vouchers

17. To redeem the movie rental vouchers, you must accept Video Ezy membership. Video Ezy membership and rental conditions apply. See in store for details. Valid at Vic and SA Video Ezy stores only for the month stated on the voucher - www.videoezy.com.au Not redeemable for cash or credit. Not to be used in conjunction with any other offer. Not valid on public holidays or store discount days. Excludes games, TV, Blu-ray discs, box sets and reserved titles. One Movie Rental voucher per Video Ezy membership per day only. The Movie Rental vouchers can only be redeemed once per month per Video Ezy membership.

18. Separate vouchers will be issued for the “free weekly rental” voucher and the “rent one get one free” new release rental voucher. The “rent one get one free” new release voucher allows for a free rental of 1 new release DVD movie upon rental of 1 new release movie of the same or greater value. The “free weekly rental” voucher entitles the holder to a free rental of
one (1) weekly DVD.

Privacy

19. By taking up this Offer you agree to us providing Edge Loyalty Systems Pty Ltd with your name, address, telephone number and email address so that your unique codes can be delivered to you and to facilitate this Offer. You authorise us to collect, maintain, use and disclose your personal information in the manner set out in our privacy policy available at www.simplyenergy.com.au

Liability

20. Edge Loyalty Systems Pty Ltd is the provider of the unique codes, certificates and vouchers. Any queries or complaints regarding the unique codes, certificates or vouchers should be made to Edge Loyalty Systems Pty Ltd at the Call Centre by calling 1300 325 422 .

21. Simply Energy will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for personal injury sustained, as a result of taking up the Offer, except for any liability which cannot be excluded by law.

22. To the full extent permitted by law, Simply Energy make no warranties or representations, whether express or implied, regarding the Offer or the Movie Rewards except as expressly provided in these terms.

23. Where legislation implies in these terms any condition or warranty, and that legislation avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of or liability under such condition or warranty, the condition or
warranty shall be deemed to be included in these terms, however, the liability of Simply Energy for any breach of such condition or warranty shall be limited, at the option of Simply Energy to one or more of the following:

a. if the breach relates to goods:
i. the replacement of the goods or the supply of equivalent goods to the satisfaction of the customer; or
ii. the payment of the cost of replacing the goods or of acquiring equivalent goods; and,
b. if the breach relates to services:
i. the supply of equivalent services to the satisfaction of the customer; or
ii. the payment of the cost of having the services supplied again.
